论确立沉默权制度的必要性

沉默权已在越来越多的国家得以确立,并写入1976年《公民权利与政治权利国际盟约》。我国尚未规定沉默权制度。建立沉默权的受益者绝不仅仅是犯罪嫌疑人、被告人个人,而是一固政府所管辖的、可能受到政府怀疑或指控的全体社会成员。沉默权已成为人类社会共享的一种资源。对于这样一种文明成果,我们没有理由拒绝它。无论从司法文明还是从人权保护角度,建立沉默权制度势在必行。
