刍议《中华人民共和国禁毒法》第六十五条

《中华人民共和国禁毒法》的通过,在我国的禁毒史上具有里程碑的意义,伴随该法的实施,必将给我国的禁毒工作带来巨大的影响。但是该法第65条中存在一些概念的内涵和外延模糊不清且无相关的立法解释或司法解释予以阐明,如"娱乐场所"、"从业人员",这种模糊的情形极易造成该法被有差别的执行。此外在65条第2款中对于娱乐场所经营管理人员主观上"明知"的界定也无统一的认定标准,加之该法65条第2款中关于"聚众"吸食、注射毒品的规定,含有篡改刑法第354条之嫌,上述问题亟待阐明。
