随着城市化迅猛发展,住宅小区越来越多,城市私家车拥有量不断增长,使得车库日益成为居民的稀缺资源。车库所有权在实践中颇具争议,《物权法》对车库所有权的归属界定存有立法缺陷,在司法实践中不具有操作性,为此特提出了相关的立法建议,这对理顺产权关系,使法律不仅能够客观地反映社会生活,而且可以正确地规范人们的财产关系,起到定纷止争的作用。

Because of the increasing quantity of private cars,garages has become rare resources with the rapid development of cities and residence districts.In practice,the ownership of garage has been a controversy for Property Law has a legislative defect on definition about the attribution of grarge s ownership.This paper offers some suggestions for legislation in order to make clear the property right relationship,make law reflect social life objectively,standardize people s property relationshi.
