摘要
竞业禁止协议的效力判断是一个价值评价问题,只能从其价值实体即竞业禁止协议和价值标准即社会的需要两个方面来考察。价值标准是个历史范畴,受到市场经济成熟度、公民的权利意识、劳动力市场的供求关系、竞业禁止制度实施的成本等因素的影响,在不同历史时期、不同的历史条件下有不同的内容。竞业禁止协议效力的判断必须遵循择业权优先、经营权兼顾;合理限制、利益平衡;针对在职期间的与离职后的竞业禁止协议各自特点分别进行制度建构等原则,方能紧扣我国的社会实际,在经营权与择业权之间达致平衡。
