摘要
本文论证了宪法平等权的性质,平等和合理差别的关系,结合就业歧视个案提出了在司法实践中适用宪法平等权的法律依据和条件,以及应当注意的问题,对宪法平等权的司法适用问题做了初步探讨。
This essay expounds and proves character of constitution equality right and the relationship between equality and reasonable diversity. Linking up with the individual case of employment discrimination,it puts forward the legal basis and conditions which are applicable to constitution equality right in the judicial practice and the questions to be noticed,making an initial enquiry of the legal application of constitution.
