The Establishment of Chinese Community Home Correction System for Juvenile under the Background of Harmonious Society

中国基于刑罚谦抑的司法理念于2003年隆重推出社区矫正作为司法改革的重要措施之一。目前,社区矫正还处于试点阶段,未成年人社区矫正制度的构建尚处于起步和探索阶段。依托少年司法制度,未成年人社区矫正制度之构建旨在与联合国少年刑事司法准则接轨,取得了一定的矫正效果,已经成为司法改革的亮点。

Being prudent to the penalties is a traditional belief in the criminal law,which makes China introduce the Community Home System as an important measure into the judicial innovation.At present time,the system is still in the test and takes its very first step to the maturity.Along with the judicial system on juvenile,the establishment of the Community Home System aims to match with the standard of UN’s Rule of Criminal Judicature,and it is becoming the highlight in the judicial innovation.
