摘要
就业保护权是劳动者维持和保护劳动关系不受雇主主动解雇的重要权利.就业保护权在用人单位解雇劳动者的过程中对实体、程序以及救济进行了系统地规制,对于保护劳动者合法权益具有重要意义.在分析我国当前劳动法规现状的基础上,对我国《劳动合同法》及相关法规的完善提出了建议.
Employment protecting rights are the critical rights of labourers to maintain and protect the labour relationship and not to be dismissed by employers of their own accord.In the process of discharging labourers by employing units,the employment protecting rights make systematic regulations on the entity,procedure and relief,which is of great significance to protecting the legal rights and interests of labourers.Based on analyses of the current situations of our existing labour laws and regulations,this paper presents suggestions for improving our Law of Labour Contract and related laws and regulations.
