当代大学生权利的法治保障——高等学校权力的限度

随着高校改革的深入,学校与学生之间的关系也在发生着深刻的变化,在某些方面出现了过去未有的矛盾和问题。近几年来,高校在管理过程中侵犯大学生权利的现象时有发生,大学生状告学校侵权的法律纠纷也呈上升趋势。可见高等教育法治化的当务之急就是要确立高校权力与学生权利的理性化配置的制度,进一步理顺并明确教育事业的基本主体——高校、教师、学生三者相互间的权利与义务关系。这对于保护学校、教师、学生的权利,调动高校办学的主动性、教师教学的积极性以及学生学习的自觉性,保证教育秩序的稳定,促进高等教育的健康发展,有着极为重要的现实意义。

With the reforms in universities deepening,the relationship between school and students has changed greatly.In some aspects,there appears some conflicts and issues that never occured before.In recent years,in the process of management,the universities infringed students’ right so much that there are increasing number of students who bring an action against school.Therefore,as to higher education’s principle of rule by law,the urgent task is to establish the reasonable system between university authority and students’ right,and go further into confirming the rights and duties among the main body of education--university,teach and students,which has great significance to protect their rights,promise the stability of education oreder,and promote the healthy development of higher education.
