The Progress and Deficiency of New Marriage Law from the Perspective of Protecting Female Rights

从保护妇女权益的角度看,新婚姻法对旧法有重大发展:增加了夫妻忠实义务、禁止家庭暴力、离婚损害赔偿制度等内容,首次承认了家务劳动价值,规定了经济帮助的具体方式。该法在修订后依然存在一些不足:家庭暴力在救济的具体操作及协调方面还存在问题,离婚损害赔偿的适用范围比较狭小,女性生育权优先性的规定尚显不足。

The promulgation and implementation of the public focused on new marriage law make a series of mending,increase and deletion to the original one.This paper discusses the important development of the new law from the perspective of protecting the female rights.It increases some contents,such as the loyalty obligation between husband and wife,the forbiddance of domestic violence,the compensation system of divorce damage,and so on.It admits the value of housework for the first time,and formulates the specific way of financial help.Furthermore,this paper also analyzes the deficiencies in the repaired law,for example,problems in the concrete operation of domestic violence remedy and coordination,the narrowness of divorce damage compensation in applicable scope,the inadequateness of stipulation in women's priority of birth right.Meanwhile,the author gives his own suggestions.
