摘要
我国没有将农地发展权从农村土地所有权中独立出来并由政府收购。因此从所有权的角度可以看出,我国的农地所有权是一个完整所有权。在国家解除对农地的用途管制之后,将农业用地转为工商用地的权利应由农地所有权人享有。以此观之,我国农村土地所有权被征收时所获得的补偿与该土地再由政府转卖时的价格之间形成了一个巨大的差价便失去了其存在的合理性。
In our country,the land development right was not independent to the property rights,so has not been purchased by the government.Therefore if we see from the property rights angle,we can find that our country agricultural property rights are completely property rights.When relieved the use control by the country,the rights to transfer from the agricultural use to the industrial and commercial use should be enjoyed by the agricultural property rights holder.By this view,the huge price difference between the compensation given by the government and the price when the government resells the land loses its existence rationality.
