善意取得制度是近代以来民事法律中的一项重要制度,我国在制定民法典时也应考虑通过立法将其确定下来。本文通过对善意取得制度的源起、构成要件的论述,肯定了善意取得制度存在的理论和实践基础,希对本制度的研究有所裨益。

The system of the well-meaning earning is an important system in the civil law since the modern times. Setting up the civil law code our country should consider fixing it through the legislation. Through discussing on the origin, the composition parts of the system of well-meaning earning, this paper has confirmed the foundation of theory and practice for the system of the well-meaning earning. The author hopes this paper will help to study this system.
