我国精神损害赔偿的现状透视

On Actuality and Countermeasures of Compensation of Spiritual Hurt in Our Country

精神损害赔偿的立法和实践在我国经历了《民法通则》概括规定阶段 ,立法、司法混乱阶段 ,立法全面规定的司法统一阶段 ,取得了巨大的进步。但仍存在着司法解释越权立法、精神损害赔偿范围过窄、法律不协调等重大问题。其中 ,关于死亡赔偿金、伤残赔偿金等同于精神抚慰金的观点就违背了民事赔偿的基本原理 ,是一种倒退。应尽快修订《民法通则》 ,对精神损害赔偿进一步完善。

The legislation practice of compensation for spiritual hurt has gone through three phases:epitome prescription in general rule of civil code,confusion in judicature,unification in judicature,and made great progress.But it still exists grave problems,for example,judicatory explanation legislation exceeds its authority,the bound of compensation for spiritual hurt is too narrow,the law is out of line,etc.Therein,the viewpoint of thinking death compensation or compensation for the wounded and disabled remnant is equal to compensation of spiritual hurt breaches the basic principle of civil compensation,is a sort of retroversion.It is suggested that general rule of civil code should be revised as soon as possiple and the compensation for spiritual hurt should be further perfected.
