国有企业专利权管理体制存在着种种症结,主要表现在发明人的从属地位使其利益难以落实、企业专利权主体虚位、专利管理缺乏统一性和连贯性等。因此,必须借鉴发达国家立法观念和管理经验,从权责分配、激励机制和管理结构上有针对性地进行改革和调整,逐步改进和完善我国的知识产权管理体制。
