论我国知识产权领域中的反垄断法律制度

Anti-monopoly Systems in China Intellectual Property Rights Field

知识产权在一国乃至世界经济的发展中起着越来越重要的作用,对知识产权的保护也越来越受到各个国家的重视,但与此同时,知识产权人滥用知识产权的行为也愈演愈烈,各国纷纷出台法律对其加以规制。我国刚刚出台的《中华人民共和国反垄断法》也单列一条对其加以规范,但其规定过于抽象、原则。分析知识产权与反垄断法的关系,解析实践中相关滥用知识产权的行为,比较国外规制滥用知识产权行为的立法经验,对我国知识产权领域中的反垄断提出一些完善建议,以期指导法律实践。
