On the Combination of Leniency with Punishment on Financial Crime in Chinese Criminal Legislation

我国刑法的金融犯罪构成要件存在缺陷,无法适应新形势下遏制金融犯罪的刑事政策的需要,应当根据宽严相济刑事政策对我国金融犯罪刑罚结构重新设计:一方面应当严密金融犯罪的刑事法网,严格金融犯罪的刑事责任;另一方面基于对刑罚权可能被滥用的警惕,设计相应的刑罚排除机制,进行适度的限制与节制,以实现刑罚的宽缓。

There are some defects in the elements of financial crime of China s criminal law.They can not adapt to the demand of criminal policy of holding back financial crime.The penalty structure on financial crime should be redesigned according to the criminal policy of combination of leniency with punishment,which should tighten the criminal justice of financial crime and stricten the criminal duty of criminal crime on one hand and on the other hand,should design corresponding exclusive system of penalty and have...
