“代为立功”的法律规制

“代为立功”是指在行为人因涉嫌犯罪被抓获之后,应司法机关或者其工作人员的要求,或者由犯罪嫌疑人及其亲友主动提出,由犯罪嫌疑人的亲友为司法机关提供其他人的犯罪线索,或者协助司法机关抓获其他犯罪嫌疑人,或者协助司法机关破获其他案件,从而希望司法机关对犯罪嫌疑人减轻处罚的制度。“代为立功”常常运用于毒品犯罪、走私犯罪、有组织犯罪、职务犯罪案件的破获或者犯罪嫌疑人的抓获。“代为立功”利大于弊,具有司法交易的性质,可以通过在刑法与刑事诉讼法中明确规定“代为立功”的构成条件、限制性规范、对刑罚的影响、操作途径的方式,在我国法律规范中确立“代为立功”制度,将其与自首、立功并列。
