将反性骚扰纳入民事立法的议程 被引量:1

Need to Include Anti-sexual Harassment Clause in China's Civil Law

摘要 自2001年7月以来,中国大陆已经有十余起性骚扰民事诉讼案件。原告经历的艰难立案过程以及多数案件最终败诉,与中国民事实体法和程序法中反性骚扰立法的缺失有直接的关系。2005年的《中华人民共和国妇女权益保障法》修正案明确规定禁止对妇女实施性骚扰,但是,保障原告顺利发动诉讼,改变“借名诉讼”和法院审理此类案件无所依存的局面,需要中国的民事立法加以呼应。文章认为,我们应当借鉴国际社会、其他国家的相关立法和司法实践,充分考虑中国历史、文化等社会背景,在民法、劳动法、民事诉讼法等法中增加反性骚扰的内容。目前反性骚扰的立法可以先由最高人民法院做出司法解释。 Since July 2001,more than 10 sexual harassment-related civil cases appeared in Chinese mainland.Most of the plaintiffs lost the lawsuits having experienced difficulties in legal procedures,which directly resulted from the absence of anti-sexual harassment clauses in China's civil substantive and procedural laws.The Law of the People's Republic of China on the Protection of Women' Rights and Interests amended in 2005 stipulates clearly that sexual harassment against women is prohibited.But it's still far from enough.China's civil law should adopt protective clauses to enable plaintiffs to launch lawsuits and to offer legal basis for the court to handle such cases.Therefore,learning from international community and other countries' legislation and judicial practice,anti-sexual harassment clauses should be included in China's civil law,labor law and civil procedural law especially by taking full consideration of China's history and cultural tradition.Judicial interpretation by the superior People's court can perhaps be the first step for China to adopt legislation against sexual harassment.
