我国监护制度之不足及其立法完善

Defects of China's Guardianship and Perfection of its Legislation

我国现行的监护制度对监护的种类、临时监护人、监护人的资格、监护的拒绝或辞退的法定事由、监护权的转让、监护人的报酬和职责、监护人的范围、监护的变更和终止的原因及程序、未成年人在校期间监护责任、共同监护等问题存在着一些不足。本文针对这些问题提出了一些立法建议,以完善我国的监护制度。

There exists some defects in China's current guardian system:the types of guardianship,temperary guards,the qualification of the guards,the reasons to refuse or dismiss the guardianship,the transfering of the guardianship,the pay and respansibility of the guards,the reasons and procedures to transfer or stop the guardianship, and the guarding resposibilities for the guardianship,ect. This thesis raises some suggestions to perfect our guardian system.
