On the Native Resources of Economic law

在法治建设中对法律移植的过分强调,轻视法律背后的整个社会背景的思想,在某种程度上,导致对法律本土资源的忽视。作为规范市场经济最基本的法律——经济法,在发展中不可避免要进行法律移植。但同时更应关注经济法本土资源,关注中国的实际状况。

During the construction of rule by law,the idea of overemphasizing the law transplantation but underestimating the whole social background behind the law,to some extent,leads to ignoring the native resources of law.As the most basic law regulating the market economy,economic law will make law transplantation inevitably in the development.At the same time we ought to focus on the native resources of economic law and the reality of China.
