摘要
借鉴澳大利亚集体劳动合同法律制度的思维方式,中国应依法允许包括雇员所在单位工会在内的多种社会组织,代表雇员与雇主谈判、协商和签订集体劳动合同,并给集体合同的当事者留出充分的自由选择空间,由雇佣劳动合同当事人依自己所处的环境和条件,来决定其与雇主所签订集体劳动合同的批准程序和方式。
Seeing that typical market economy country's thinking method in the legal system of organized employment contract,China should allow varied social organization in which employees have membership,including labor Union,to negotiate to consult and sign the organized employment contract on behalf of the employees,while the parties of the organized employment contract should be given enough freedom to decide approval process and method of the organized employment contract according to the situation and condition the parties of the organized employment contract to be.
