人民监督员制度的现状、问题与完善——以广东省的检察实践为视角

The Present Situation,Problems and Improvement of People′s Supervisor System——A Practical Perspetive of Guang Dong′s Procuratorial work

人民监督员制度顺应了公民参与司法的潮流,是检察机关自主创新的一项司法改革。该制度实施两年多来成效初显,但仍有不少问题亟待解决。应从实证研究的角度对该制度的运行现状及存在问题进行系统分析。建议通过明确司法独立与人民监督的辩证关系,推动该制度立法的跟进和到位,以及加强该制度的实效性等方面,来进一步完善人民监督员制度。

The people′s supervisor system complies with the trend of the citizen′s participating judical exercise.It′s a judicial reform of the procuratorial agency with the object of independent innovation.This system has been implemented for more than two years,and we have reaped the first fruits,but there are still a lot of questions to be solved.We should analyze the present situation and existing problems of this system at positivist′s angle.It is suggested that we should improve the people′s supervisor system by making clear the dialectical relationship between judical independence and people's supervisor,promoting the legislation of the system and strengthening its actual effect.
