论我国司法赔偿委员会的若干问题及改革

Study and Reform Proposals for the Judicial Compensatory Committee of Our Country

人民法院赔偿委员会是负责司法赔偿审理并做出决定的专门机构,但是,在实际运作中,赔偿委员会与赔偿义务机关、赔偿委员会办公室、法院、检察院以及人大的关系存在很多矛盾。针对赔偿委员会机构存在的若干问题,应借鉴国外经验,从制度的层面、国家的权力结构体系以及实体与程序结合等因素基础上探讨如何重构司法赔偿委员会的机构,使目前的赔偿委员会面临的诸多问题逐步得以解决。建议设置独立的“国家司法赔偿委员会”。

Compensatory Committee of People's Court is the special organization which is responsible for inquisition of judicial compensation,however,there are several inconsistencies between compensatory committee and compensatory compulsory agency,office of compensatory committee,People's court,People's Procuratorate,and People's Congress.It is necessary to learn external experience for conference,to rebuild the organization of judicial compensatory committee on the factors of institutional layer,state's power system,and combination between substantive law and procedural law,etc..It is hopeful to deal with the several problems compensatory committee facing,and finally the proposal that setting unattached'State's Judicial Compensatory Committee'is made as a suggestion.
