On Protection of Geographical Symbols in China

地理标志保护制度涉及国家长远经济战略和国际知识产权保护问题,用证明商标保护地理标志,存在证明商标的“公权利”性质与一般商标不同之处。在管理实施中存在缺陷,应建立法律法规审查机构和证明商标保护地理标志的统一管理机构,完善立法,增强可操作性,减少行政执法和司法人员的自由裁量权,为特色农产品获得保护提供健全的法律环境。

The protection system of geographical symbols involves the national long-term economic strategy and the protection of international intelligent property right. When people use the proved trademarks to protect the geographical symbols, there is a difference between the 'public right' of the proved trademarks and other common trademarks'. And there are some shortcomings in management practice and they need more perfection. The paper suggests that the censorship and the unified management organization should be set up in order to perfect the legislation, improve the feasibility and reduce the free judge of the administrators and justice personnel, thus to provide a sound legal system to protect the characteristic farm products.
