On the Uncertain Conclusions in Judicial Appraisals:Taking the Handwriting Appraisal as Inspection Visual Angle

在司法实践中,不确定性鉴定结论的客观存在制约了鉴定结论在诉讼中的作用。较为理想的鉴定结论应当解决了特定的案件争议事项,是对鉴定要求的明确答复。针对司法鉴定中不确定性鉴定结论产生的原因,其应对措施应提高鉴定人员的知识、经验、技能;收集真实、可靠、充分的检材;使用成熟的鉴定理论和方法;排除对案情不利的因素开展鉴定。

In the judicial practice,the existence of uncertain conclusion of appraisal has objectively restricted its functions in the lawsuit.The ideal appraisal conclusion should be the one that has solved the disputes of a specific case and explicitly reply to the requirements of the appraisal.In the light of reasons of producing uncertain conclusions in judicial appraisals,the countermeasures should be: enhance appraiser's knowledge,experience and skills;collecting authentic,reliable and full materials;applying mature appraisal theories and the methods;eliminating disadvantageous factors of cases to carry out appraisals.
