初探社区矫正制度的法律架构与完善

On legal framework and improvement of community correction system

社区矫正是与监禁刑相对应的一种行刑制度,社区矫正制度在我国试点以来取得了一定的效果,但目前法律的滞后与缺失使得实践中存在操作不便、制度不统一、各部门相互推诿等现象,本文从社区矫正制度的法律滞后入手,提出了完善社区矫正制度法律架构的对策性建议,以期对司法实践有所裨益。

Community correction is a corresponding execution system to the sentence of imprisonment. Community correction system in China has made some trial results. However, the lag and imperfection of the law make the inconvenience exist in practice, the system be not unified and shuffle among departments. From the legal lag of community correction system, the article put forward a sound suggestion to improve the legal framework of community correction system and expected the benefit to judicial practice.
