完善我国行政听证制度之初探

Preliminary Exploration of the System of Administrative Hearing of Witness in Our Country

我国近年来借鉴了西方国家的成熟经验,初步确立了行政听证制度。但与国外相比,我国的行政听证程序尚不完善,无论是制度本身还是在行政听证实践中,都有许多需要改进和完善的地方。应当扩大行政听证的适用范围和听证参加人的范围;健全行政听证主持人制度,使其具有独立性;完善行政听证笔录制度等,以此进一步完善我国的行政听证制度。

Our country has recently borrowed the sophisticated experience from the western countries and preliminarily formed the system of hearing of witness.Compared with the western advanced experience,there is still much to be improved in the procedure of the system either in the respect of the system itself or in the practice in our country.In this paper the author proposed that the practice of administrative hearing of witness should be applied in larger scale and should be attended by more people,that the chairing system should be improved to be independent and the system of taking-down-notes should be perfected so as to improve the system of administrative hearing of witness in our country.
