摘要
法学案例教学法,是指运用精心选择的案例,通过教授者积极引导和学习者自主学习,使学习者系统理解法学理论知识、掌握法律技能和领会法律精神的一种教学方法。在法学案例教学过程中,案例的选择与问题的设计是关键,案例教学的组织是重点。有效的案例分析方式有课堂分析、模拟法庭分析、诊所式法律教育分析、真实审判观摩分析四种。然而,案例教学法目前在我国高校法学教育中要得到很好的运用还面临诸多限制,教育界需要寻求相应对策。
The case method of jurisprudence refers that the teacher inducts the students to understand the jurisprudential theory systematically, grasp the legal skill and comprehend the spirits of the law through analyzing the cases chosen elaborately.The key is to choose the cases,to design the questions and to organize the case analyzing in the process of the case teaching.There are four useful ways of case analysis as following: classroom analysis,simulated court analysis,clinical legal education analysis,and real trial observation analysis.There are some limitations to exercise the method in our jurisprudential education.
