摘要
重点探讨了劳动争议案件在劳动合同法律关系定性基础上适用私法原则和具体条文的若干问题,澄清了在法律实务中应当以肯定的观点来回答劳动争议是否适用民法通则和合同法的问题。此外,本文还提及人员借调和劳动合同概括转让所产生劳动争议的法律适用问题。
This paper mainly discusses some problems of the applicableness of applying private law rules and specific clauses to labor dispute cases on the basis of qualitative relation of labor contract, it also clarifies the negative position whether the general principles of civil law and contract law should be applied to the labor disputes. Furthermore,the law applicableness derived from the temporarily transfer of staff and the generalization of labor contract is mentioned in the paper.
