率由旧章:前近代汾河流域若干泉域水权争端中的行事原则

To Abide by the Old Rules:The Principles in Solving Water Disputes in the Several Drainage Areas of Fenhe in Pre-modern China

"率由旧章"是前近代山西省汾河流域各级地方政府解决水权争端的一项习惯性行事原则。尽管该原则能够止息一时的水争,但隐藏在水案背后的很多现实问题却被搁置起来,未能彻底解决,华北乡村社会亦由此陷入原地打转的困境,不利于资源的有效配置和制度的创新与演进。从本质上讲,这一行事原则的盛行乃是传统文化起作用的结果。
