摘要
贸易与劳工标准挂钩实乃国际经济和社会发展的要求和必然趋势,发展中国家对劳工权入世之目的、劳工权实现的方式、对比较优势的影响、被滥用的可能以及消极对抗之后果的认识存在误区。发展权作为一项综合性人权和特别发展进程的权利,亦不能为拒绝劳工权入世提供理论支撑。发展中国在未来谈判中通过主张限制劳工权入世的范围方式、制定免诉条款、实施差别待遇、限制惩罚性措施的使用和加强与ILO的合作等措施,不仅可以有效的降低劳工权入世对其比较优势和国际竞争力的负面影响,并且可以改善本国的劳工状况。
