Study on the Concepts of Russian Federal Penalty Legislation

俄罗斯联邦刑罚立法概念分为"本质特征"、"内容特征"和"形式特征"三个特征群。在刑罚立法技术上,俄罗斯联邦刑罚概念具有一定的合理性和先进性。本文通过俄罗斯联邦刑罚概念传统和现行学说的研究,对我国刑罚立法概念提出了较为科学和明确的定义,这对于刑罚基本制度的研究、刑罚的正义执行具有重要的意义。

Concepts of Russian federal penalty legislation embody three character groups-essence character,content character and form character.The concepts are relatively rational and advanced in legislative techniques in penalty.Through the study on the traditional and current concepts of Russian federal penalty legislation,the thesis is trying to define the concepts more scientifically and clearly,which has significant meaning in study on basic system of penalty and the right execution of it.
