在民法现代化进程中 ,物权客体的范围日趋宽泛 ,有形财产、无形财产、动产、不动产已无所不包。然而 ,科学技术的发展和进步给人类社会带来的诸如试管婴儿、克隆人、人造器官等新生物 ,又对传统的民法理论提出了挑战。本文拟就人体器官、遗体等特殊物质能否成为物权客体 ,以及如何适用法律的相关问题做一探讨。
