摘要
我国民事再审改判的基本原则应确立为程序公正、实体合理、诉讼经济、依法纠错。而确立再审改判的标准具体指应明确违反法定程序方面的错误标准和实体方面对案件事实的认定错误及适用法律超出了法官自由裁量权范围的合理度的错误标准。
The basic principles of retrial cases should be fair in the process, reasonable in entity, economical in accusation and legal in errorcorrection. The standard of retrial establishment is mainly to make clear the errors in procedure and entity, to point out the errors in evidence recognition and the judgment right of a judge.
