A Comparative Analysis of Chinese and Overseas Legislation against Smuggling

走私犯罪直接危及国家政治、经济安全,对国家危害极大,因此各国一般作为重大犯罪予以规定。走私犯罪立法的科学性对打击走私犯罪起到非常重要作用。我国目前对走私犯罪的立法还不完善,要通过研究国外走私犯罪的立法,借鉴其科学、先进的东西,促进我国走私犯罪立法的完善。

Smuggling is generally taken as a major crime because of its harms to the political as well as economic security . Whether the relative legislation is scientific is of great importance. The legislation against smuggling in China is not yet perfect and demands improvement through borrowing the scientific aspects of such legislation in other countries.
