Defining duty crime among state personnel

《刑法》第 93条规定的“国家工作人员”除了国家级权力机关、司法机关和军事机关的工作人员以外 ,在国有控股公司、企业 (包括在国有公司、企业概念当中 )中从事公务的人员也应以国家工作人员论 ;村民委员会、居民委员会的组成人员的活动应看其性质 ,当他们从事一些法律法规规定的公共事务时 ,应以国家工作人员论 ;

State personnel'provided in<penal code>Article 93 should include the staff working in the state owned companies or enterprises besides the ones in state legislative bodies,administrative departments,judicial,and military organizations.The personnel working in villager's committee,urban residents and the CCP branches at the same level should be regarded as'state personnel'when they are engaged in some public action.Otherwise,they should be not regarded as'state personnel'.Sometimes,the retired should also be regarded as'state personnel'.
