The Justice of Punishment——Balance between the Retributive Theory and Utilitarianism

在人类已有的社会实践中,惩罚是一个极为普遍的现象。当前,围绕惩罚问题的争论也越来越多,其争论的焦点在于惩罚的正义与否的问题上。对惩罚正义问题的回答一般有两种理论:惩罚主义和功利主义。本文通过对康德式惩罚主义和边沁密尔式功利主义这两种理论传统意蕴以及它们紧张关系的揭示,来展现绝对的惩罚主义和完全的功利主义都不是保证惩罚正义的合适方案。本文最后旨在指出,惩罚的正义必须形成一种建基于多元的现实之上的多元的理论,从而达到惩罚主义和功利主义之间的一种平衡。
