摘要
事实劳动关系的界定与期限是解决我国劳动纠纷的两个重要问题,《中华人民共和国劳动合同法》虽没有对其作出直接规定,但相关条文的内容已涉及。以相关法律、法规为依据,结合司法实践的经验,是解决这两个问题的关键。
The definition of actual labor relationship and the deadline are two major issues in solving the labor disputes in China.Although there is no direct stipulation in the Labor Contract Law of the Peo- ple s Republic of China,the above-noted two issues are still covered in some articles.This paper puts forward some suggestions on solving these problems.
