摘要
西方关于刑罚目的的思想主要有报应主义、预防主义、折衷主义。刑罚目的应是报应主义与预防主义的有机统一。报应主义与预防主义在刑罚的制定、适用、执行阶段应有所侧重。
The main thoughts of penalty objectives in the west are retributionalism,precautionalism and e-clecticism. The paper holds that the objective of penalty should be the unity of retributionalism and precautionalism which are treated differently in law - making and practice.
