摘要
随着网络的发展 ,域名与商标冲突也就应运而生且范围不断扩大。域名与商标有着本质的区别 ,其冲突需要重新认识。笔者从域名与商标本身入手 ,力求从经济根源、历史根源及法学原理等角度分析认识此种冲突 。
With the development of Internet,it brings the conflict between the domain name and trademark. Its scope is widening. There is an essential difference between domain name and trademark. The conflict needs further study. The author reviews its economic, historic sources and legal principles and puts forward a new theoretical construction on how to solve the conflict.
