论救助人的损害赔偿责任

Discussion on the liabilities of the salvor for damage claims

在分析有关国际公约和英国判例法的基础上 ,结合我国《海商法》和国内其他法律 ,对有关救助人的损害赔偿责任进行了探讨 ,并认为根据有关国际公约和我国法律 。

Based on several relative international conventions as well as English case law,analy zes some problems on the damage liabilities of salvor, combining Chinese Maritime Code and some provisions of Chinese civil law. It should be clarified in the international conventions as well as in Chinese law that the salvor may invoke the protection of limitation of liabilities for the damage claims because of the negligence during the course of salvage.
