被害人在世界各国刑事诉讼中的地位是不同的。但是,被害人在各国刑事诉讼中的地位开始加强,保障被害人权利成为刑事诉讼人权保障的重要方面。兼顾被告人与被害人双方利益并力争使之平衡,对被害人的保护并不必然赋予其公诉案件当事人地位是共同理念。

The positions of the victims are different in the criminal proceedings in different countries in the world.But the positions of the victims in criminal prosecution in all countries are elevated and the protection of the right of the victims is one of the important aspects in the protection of human right in criminal proceedings.The common concepts are that the benefits of both the defendants and the victims should be given due consideration and be balanced,and that to protect the victims does not necessarily give him the position of parties in the cases of criminal proceedings.
