摘要
诉前证据保全制度是证据保全制度体系的一个有机组成部分 ,其要解决的核心问题就是证据的客观真实性、合法性和准确性。建立我国诉前证据保全制度 ,有利于维护正常的诉讼程序 ,同时 ,从非诉案件的角度来看 ,它还有利于行政执法 ,仲裁裁决 ,非诉案件的审查、处罚等等。
The perpetuating testimony system before prosecution, which is a part of the perpetuating testimony system, aims at the factuality, legality, and accuracy of proof. The establishment of China s perpetuating testimony system is helpful to administrative law enforcement, arbitral award, the investigation and disposal of non-prosecution as well as the preservation of normal proceeding procedure.
