规范国有资产运营中地方政府行为的制度设计

The Designing of Systems Aimed at Standardizing Local Governmental Behavior in Operating State-owned Assets

依据对地方政府及其官员的反常越轨行为的社会学与经济学分析，阐释地方政府在国有资产 运营中应遵循的六个行为准则，分述规范性文件的制定、行政计划行为、行政合同行为、行 政指导行为和行政附款行为的具体规范，并对地方政府行为的监督机制提出若干新见解，尝 试构建一个多层次、可操作的制度体系和价值准则。

According to the analysis of abnormal deviance of local goevernment and its officials in the light of economics and sociology, this paper states the six fundamental principle that local government must follow while making decision, and separately discusses the concrete rules on formulating the document of normalization, administrative program, adminis-trative contract and administrative act with item enclosed. This paper also proposes some new views on supervising the illegal or improper act of local government in the course of the operation control of national assets, attempting to construct a legal system and value principle with multiplicity an d manipulated.
