目前仍然有相当一部分刑法学者坚持认为:'接受国家审查和裁判'是自首成立的一个独立条件.本文从该条件的历史演进与逻辑解释的两个角度,论证修订后的刑法及司法解释规定的'二条件说'已经蕴涵了原司法解释的'三条件说'.'接受国家审查和裁判'的条件在实践中已经失去了独立存在的社会条件,在思维中亦缺乏严密的逻辑基础.继续坚持自首成立的'三条件说',不仅会导致理论的荒谬,而且会影响司法实践的质量.

Now a part of criminal code scholars have still considered: ' Insistent national investigation and judge' is an independent condition of self-confession.This article has pointed out two angles from self-confession of history evolution and logical explanation. It has proved the revised criminal code and justice explaining 'two condition theory'.It has contained the old justice explaining of 'three condition theory', At practice the condition of receiving state examination and judge has lost social condition of independent existent ,short of the strict logical basis thinking.It has insistent continuously 'three condition theory' of self-confession founding.It not only to a absurd theory, but affect the quality of the justice practice.
