Comment on and Analysis of the Enforcement System of the Arbitration Award in China Concerning Foreign Factors

立法的交叉、冲突和模糊致使中国的涉外仲裁裁决在执行中屡屡受阻。本文试图从我国涉外仲裁法制的实然和应然出发 ,对中国涉外仲裁裁决执行制度进行一些理性分析 ,重点探析中国涉外仲裁裁决的认定标准以及执行中的一些制度层面上的问题。

The overlap, conflict and ambiguity of legislation frequently block the enforcement of the China's arbitration award concerning foreign factors. This article, from the necessary and present perspective of China's arbitration award system concerning foreign factors, tries to have some rational analysis of the enforcement system of China's arbitration award concerning foreign factors, with emphasis upon the identification criteria of China's arbitration award concerning foreign factors and some systematical problems of its enforcement.
