我国行政指导程序存在的问题与应对策略

The problems and countermeasures of administrative guidance procedure of China

行政指导程序对规范行政机关行政指导行为的实施,保持行政指导的灵活性、多样性具有重要意义。针对我国行政指导程序中存在的程序意识薄弱、程序立法缺乏、程序实施异化和责任承担不合理等问题,应从事前程序意识的提高和程序立法的健全、事中行政指导实施的规范、事后行政指导救济的完善三个方面来解决,以期促进我国行政指导程序化的完善。

The procedure for administrative guidance has very important significance for it can norm the implementation of the administrative guidance,and to maintain its characteristics,such as flexibility,diversity and so on.In view of the problems in administrative guidance procedure,such as the weak awareness of the procedures,the lack of procedures legislative,the alienation in the implementation of administrative guidance,the unreasonable of responsibility.We should solve these problems from three areas for the development of the procedures of administrative guidance,that is to advance awareness of administrative guidance procedure;to perfect the legislative process and the relief of administrative guidance procedure;to norm the implementation of administrative guidance.
