The Theoretical Logic of The human-oriented Conception of Legal Value

"以人为本"是在马克思主义唯物史观基础上建立的科学发展观的应有之义,它强调以人为中心,尊重人的主体地位,以人的自由的全面发展为其终极价值追求。作为其在法学领域的运用与显现,"以人为本"的法律价值观,内蕴着现代法律的人文精神与人权至上的崇高理念,体现了一种以人为终极关怀对象的精神品格。立足于此,要实现这一法律价值观,必须从观念、制度、实践三层面加以完善,使法律真正回归于人,服务于人,实现法律与人的和谐统一。

The human-oriented conception is the reflection of the outlook of scientific development which is based on Marxist historical materialism.It means that human which is the center must be respected and human's all-around development is its final target.When the human-oriented conception is applied in legal area,it asks the modern law to contain human spirit,adopt the idea that human right is supreme and shows the utmost solicitude for human.To achieve this object,it requires not only the idea of rule by law which contains humanism spirit and the right-based legal system,but also the human-oriented legal conception should be utilized to the practice which is based on democracy and science,so that the law can serve human really and achieve the harmoniousness and unification between the law and the human.
