On the Antimonopoly Law Protect Private Right

历经十三年酝酿的《反垄断法》终于颁布与生效了,对于它的讨论亦如火如荼。适逢我们讨论《反垄断法》之秩序、平等、效益等基本价值追求时,笔者认为,在《反垄断法》中,对于利害关系人私权利的保护亦尤为重要,本文欲从比较法的角度,通过剖析我国《反垄断法》私权利保护之缺失,就私权利救济的完善提出笔者之建议。

People s Republic of China Antimonopoly Law was enacted,and will take effect later after a long way of 13 years,it at-tracts society s widespread angulations.When we have discussions on Antimonopoly Law s values,such as market competition,equali-ty,efficiency and so on.We agree that it s important to protect people s private rights in the Antimonopoly Law.This article will give some advices on how to protect private rights perfectly by analysis on the Antimonopoly Law s disadvantages.
