论法律多元与我国体育法治建设

Research on Legal Pluralism and Construction of Sport Legal System in Our Country

我国的体育法治建设是一个复杂的系统工程,从法律多元的角度看,既有国家外的法律多元,包括国际体育组织;又有国家内部法律的多元性,包括大陆法、香港法和澳门法三个不同的法域以及非国家法(体育行业规则)等。法律多元带来了法律冲突,解决法律冲突问题,应该坚持国家法律至上原则,同时确立法律多元精神,在此前提下,不断进行法制创新,以达到体育多元秩序的和谐。

Construction of sport legal system in our country is great systems engineering.From the angle of legal pluralism,it includes legal pluralism outside and inside country.Outside country includes such as international sport origination,wile inside country includes such as the mainland law,Hong Kong law,Macao law and non-law.Legal pluralism brings about law conflict and the settlements of it are sticking to law and establishing the spirit of legal pluralism.
