摘要
团体人身险以团体之优势给其成员提供保障与福利,作为现代社会中普遍存在的险种,我国保险法并未对其进行区别于一般保险的规制。在实际操作中,企业指定其自身为受益人,在保险事故发生后将保险赔偿金作为抚恤金和丧葬费交给家属从而转移经营风险的做法比比皆是。为此有必要明确团体人身险的员工福利属性,将受益人的指定权回归到被保险人手中,并通过建立多层次保险体系完善企业内部的运营和职工保障机制。
